Case Summary
🥁 1. Background
The applicants, a family of three, were granted initially Australian Permanent Residency (PR) in August 2009 through an offshore visa. After receiving the visa, they made two short visits to Australia, each lasting less than four weeks.
At the time, their child was still young, and they had no prior experience living in Australia. After careful consideration, they decided to return to China to continue their lives and businesses.
Not long after their PR expired, they spoke with a migration agent who advised them that they would need to reapply for PR through skilled or business migration. Since their business in China was thriving and they assumed there was no way back, they gave up entirely. For over 10 years, they had no further contact with Australia.
We first heard from them in 2019, but the COVID-19 pandemic soon began. It wasn’t until 2023 that they finally decided it was time to return to Australia and asked us to help them recover their PR status.
🎯 2. Case Challenges
By the time they reconnected with us, it had been more than 10 years since they last held a valid PR visa and were physically present in Australia.
The biggest challenge
The family had never worked in Australia, never purchased property here, and had barely any ties to the country after the visa was granted. There were no records of local activity, no tax history, no school enrolments, and no ongoing connections.
Once we officially took on the case, we carefully worked out a strategy tailored to their specific situation. We worked closely with the family to understand their return plans and helped them uncover every possible detail to support their case. At the same time, we gathered evidence to clearly explain their extended absence from Australia and the reasons behind it.
🏆 3. Outcome
We helped the applicants prepare nearly 60 documents, including a detailed legal submission explaining their circumstances and commitment to returning.
Thanks to the strength and completeness of the application, the Department approved the return of their PR just 2 working days after lodgement.
They now hold valid Australian PR once again, a journey that began 15 years ago, and found closure in just 48 hours.
